Information on Actsoft’s Privacy Policy


Actsoft, Inc. (“Actsoft” or “we”) recognizes that its subscribers (“subscriber”, “user”, or “you”) are concerned about how the information they provide Actsoft will be used. Actsoft will be the sole owner of the information collected on our web site (the “Site”) or otherwise, and we will not sell, share, or rent this information to others, except as necessary to service our subscribers’ accounts. The means by which information is collected, and the respective uses of that information, are described in the following paragraphs:

1. Registration

In order to use our Site to subscribe for and/or use our services (the “Services”), a subscriber must first register with us by completing the registration form. During registration a user is required to give standard information such as, address, phone number, fax number, email address, mailing address and type of business. This information is used by Actsoft to identify the user as a potential subscriber and assign an Actsoft account number to the subscriber. It is optional for the user to provide certain information (such as fax numbers), but encouraged so we have additional means to contact the subscriber if necessary. If you are subscribing for our Services through your equipment carrier, we require information such as your carrier account number and the name of your carrier account representative. If you are subscribing for the Services directly through us, we may request information regarding your billing address (if different from the registration address) and financial information (like credit card number and expiration date). This information is used for billing purposes. To the extent necessary, this information is provided to credit card processing companies and other third parties whose services may be necessary to process your payment. Through the registration process, we also request information to assist us in providing our Services to you, such as your business objectives as they pertain
to the Services for which you are subscribing.

2. Use of the Services

When using our Services, the subscriber will provide a variety of information to us, which may include employee numbers, job numbers, start and stop dates and times, quantities and descriptions of certain items being tracked, and vehicle information. Further, in providing our Services, we may record subscriber inquiries and the information provided by us to the subscriber. We may also track and use subscriber information requests for the purpose of providing additional information that might be of interest to our subscribers.

By downloading Actsoft’s Application (the “Software” or the “Application”), you agree, represent and warrant that your use of this Application will be solely for your lawful use and for no other purpose. You cannot use this Application to collect, or otherwise use any information to Engineer or Reverse Engineer a similar product offering for use internally or for resale. By requesting, subscribing to and/or using this Application, you are consenting and permitting Actsoft, Inc. (“Actsoft”) to gather, collect, disclose and use information regarding the location of this device in order to deliver the location based services provided through the use of the Application you are downloading. Actsoft does not guarantee the accuracy or completeness of any information including location information displayed through this Application. Always use caution when displaying and disclosing personally identifiable information about yourself or your location to others. Do not attempt to enter or change information while driving. Service could be interrupted or disrupted due to atmospheric conditions and other factors associated with use of satellites and satellite data. Location based services may require the use of certain handsets. Internet access required for use. Airtime and/or Wireless Data charges apply.

Actsoft restricts our access, collection, use, and sharing of personal or sensitive data acquired through the application to purposes directly related to providing and improving the features of our application. Under no circumstances do we use location data collected for any purposes outside of our application. No personally identifiable information is collected or used outside of our software application. Furthermore, Actsoft handles all personal or sensitive user data securely, including transmitting such data using our encryption protocols.

Actsoft provides customers an in application disclosure regarding how we collect data. We ask customers to accept an End User License Agreement (EULA) that defines how such data is used for the sole purposes of our application. Customers must provide their consent in order to access and utilize our software application.

3. Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. We use cookies to enhance our subscriber’s browsing and data analysis experience on our Site. For example, we receive and collect the name of the domain and host from which you access the Internet, the Internet protocol (IP) address of the computer you are using, the browser software you use and your operating system and if applicable, the Internet address of the web site from which you linked directly to our Site. The cookies transmit this information back to the computers hosting our Site, which are the only computers authorized to read such information. This information makes it possible for us to (i) speed navigation, keep track of search results and provide subscribers with custom tailored content; (ii) remember information you gave to us so you do not have to re-enter it each time you visit the Site; (iii) monitor the effectiveness of certain of our marketing email campaigns; and (iv) monitor total number of visitors, pages viewed, and the duration of the Site visit. In short, all of the information we automatically capture provides us with the ability to enhance our subscribers’ search and data analysis experience, and to determine aggregate information about our subscriber base and usage patterns.

Most people do not know that cookies are being placed on their computers when they visit web sites because browsers are typically set to accept cookies. You can choose to have your browser warn you every time a cookie is being sent to you, or you can turn off cookie placement. If you refuse cookies, you will not be able to use all of the features and functionality of our Site.

4. Log Files

We use IP addresses to analyze trends, administer the Site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

5. Sharing

We may from time to time share aggregated demographic information with our business technology partners. This is not linked to any personal information that can identify any individual user. We may use a credit card or payment processing company to bill subscribers for services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. We may partner with another party to provide specific products or services, such as when we partner with your equipment carrier in connection with our provision of the Services. When the subscriber purchases these third party products or services, we will share names or other contact information that is necessary for the third party to complete the order. These parties are not allowed to use personally identifiable information except for the purpose of completing the order.

6. Links

This Site may from time to time contain links to other sites. Please be aware that Actsoft is not responsible for the privacy practices of such other sites and this privacy statement applies solely to information collected by our Site. We encourage our users to be aware when they leave our Site and to read the privacy statements of each and every site that collects personally identifiable information.

7. Surveys

From time-to-time our Site may request information from users in the form of a survey. Participation in any survey is completely voluntary and the user, therefore, has a choice whether or not to disclose this information. If the survey question relates to our Services, the survey information will be used only for the purposes of monitoring or improving the use and satisfaction of the Services. Your survey response will be reflected in the survey results, but will never be provided to a third party in a manner which links your vote with your personally identifiable information.

8. Security

Actsoft takes every precaution to protect our users’ information. When users submit personal information via the Site, your information is protected both online and off-line. For example, when our registration form asks users to enter personal information (such as address or telephone number) that information is encrypted and is protected with one of the best encryption software products in the industry – Secure Sockets Layer (SSL). While on a secure page, such as our registration form, the lock icon on the bottom of Web browsers such as Google Chrome, Microsoft Internet Explorer, and Mozilla Firefox becomes locked, as opposed to un-locked, or open, when you are just surfing.

While we use SSL encryption to protect personal information online, we also take steps to protect user-information off-line. All of our users’ information is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a subscriber service representative) are granted access to personally identifiable information. Our employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to your information. Furthermore, all employees are kept up-to-date on our security and privacy practices. Any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our subscribers’ information is protected. Finally, the servers that we store personally identifiable information on are kept in a secure environment.

9. Supplementation of Information

In order for this Site to properly fulfill its obligation to our subscribers, it may be necessary for us to supplement the information we receive with information from third party sources. For example, to determine if our subscribers qualify for available credit, we may use their name and social security number to request a credit report. Once we determine a user’s credit-worthiness, this document is destroyed.

10. Special Offers

Established subscribers will occasionally receive information on products, special deals, and company news. These offers may be made via email, regular mail, text message or telephone. Out of respect for the privacy of our users, we present the option to not receive these types of communications. At no point does Actsoft share or expose any personally identifiable information. Please see our choice and opt-out policy below.

11. Site and Service Updates

We may also send the user periodic updates relating to material changes in our Site or the Services. Users are not able to un-subscribe from these announcements, which contain important information about the operation of our Site and provision of the Services. We communicate with the user to provide requested Services or in regard to issues relating to their account via email, phone, fax or U.S. Mail.

12. Correction/Updating Personal Information

If a user’s personally identifiable information changes (such as your zip code), or if a user no longer desires to be registered as a user of our Site, we will endeavor to provide a way to correct, update or remove that user’s personal data provided to us. 13. Choice/Opt-out

Our subscribers are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to our Site at the point where we ask for the information. For example, our registration form has an ‘opt-out’ mechanism so users who buy a Service from us, but do not want any marketing material, can keep their email address off the lists we use for promotional purposes. Subscribers who no longer wish to receive company news or promotional materials may opt-out of receiving these communications by directing a request to unsubscribe to bounce@actsoft.com.

14. Notification of Changes

If we decide to change our privacy policy, we will post those changes on our Site so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
